Terms of Service for Andreas Horn Photography Newsletter

These Terms of Service (”Terms”) govern your access to and use of Stoic Explorer (the “Newsletter”), hosted on Substack (https://hornandreas.substack.com). By subscribing or accessing the Newsletter, you agree to these Terms. If you do not agree, do not use the Newsletter.

We are Andreas Horn, located in Germany (”we,” “us,” or “our”). Contact us at hornandreas@substack.com.

These Terms supplement Substack’s Terms of Use and Privacy Policy. In case of conflict, these Terms prevail for matters specific to our Newsletter.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to subscribe. By subscribing, you confirm you meet this requirement.

2. Subscriptions and Payments

• Free Subscriptions: Access to free content requires providing your email.

• Paid Subscriptions: Processed via Substack. Fees are non-refundable except as required by law (e.g., 14-day withdrawal right under EU consumer law for digital services). Cancel anytime; access ends at the billing period’s close.

• Changes: We may adjust pricing with notice. Continued use after changes implies acceptance.

3. Content and Intellectual Property

• Our Content: All Newsletter content (text, images, etc.) is owned by us or licensed. You may not reproduce, distribute, or create derivative works without permission, except for personal use.

• User Content: Comments or submissions grant us a non-exclusive, royalty-free license to use them in the Newsletter. You warrant your content does not infringe third-party rights.

• Prohibited Conduct: Do not use the Newsletter for illegal activities, spam, harassment, or infringing content.

4. Privacy

Your personal data is handled per our Privacy Policy (linked above). By using the Newsletter, you consent to such processing.

5. Disclaimers and Limitations of Liability

• As-Is Basis: The Newsletter is provided “as is” without warranties. We disclaim liability for inaccuracies, interruptions, or viruses.

• Limitation: To the extent permitted by law (including EU consumer rights), our liability is limited to direct damages, capped at the amount you paid in the last 12 months. We are not liable for indirect, consequential, or punitive damages.

• Force Majeure: Not liable for events beyond our control.

6. Termination

We may terminate or suspend your access for violations, with notice where possible. Upon termination, your rights end.

7. Governing Law and Dispute Resolution

These Terms are governed by German law. Disputes shall be resolved in the courts of Munich, Germany.

8. Changes to Terms

We may update these Terms. Changes will be posted with the updated date. Continued use constitutes acceptance.

9. Miscellaneous

• Severability: Invalid provisions do not affect others.

• No Waiver: Failure to enforce does not waive rights.

• Entire Agreement: These Terms constitute the full agreement.
